A landmark decision to reject a claim against tobacco giant Imperial Tobacco has been welcomed by the Forum of Insurance Lawyers (Foil).
Margaret McTear sued the company for £500,000 after her husband, Alfred, died of lung cancer.
Judge Lord Nimmo Smith said he was unconvinced of the connection between her husband's illness and his 60- a-day habit.
In delivering his judgment, Judge Lord Nimmo Smith said Mrs McTear's case had failed on every count.
He said the public was "well aware" of the potential risks from smoking in 1964.
Foil president Andrew Underwood said it was a "common sense decision" that reflected "the reality of the environment in which the claimant decided to smoke and continued to smoke."
