MoJ will consult on the review later this year
Implementing the Jackson Review of the personal injury claims process will be a priority for the government, it has announced.
The Ministry of Justice will consult this autumn on how to implement the review’s recommendations, focusing particularly on conditional fee agreements (CFAs). In the review, Jackson proposed making success fees and ATE insurance premiums non-recoverable, which would require primary legislation.
The consultation will also look at the role of contingency fees.
Justice minister Jonathan Djanogly said: “High costs under the existing arrangements have become a serious concern.”
Allianz head of technical claims Roy Hebburn said the move sent a “very positive signal”, while AXA managing director of claims David Williams commented: “It is important to maintain the pressure.”
President of the Forum of Insurance Lawyers Dan Cutts warned against a fragmented approach: “We need to keep the package together as Jackson set out.”
